The Government Office conveys the Prime Minister's opinion Government on Ho Chi Minh City's proposal on difficulties and obstacles of the 10,000 billion VND flood prevention project.
This agency has sent an official dispatch to the Ministry of Justice, the Ministry of Public Security, the Ministry of Finance, the Ministry of Planning and Investment, the Ministry of Construction, the Ministry of Natural Resources and Environment, the Ministry of Agriculture and Rural Development, the Government Inspectorate, the State Bank of Vietnam, and the Vietnam Joint Stock Commercial Bank for Investment and Development.
Accordingly, the Government Office received a report from the Ho Chi Minh City People's Committee on the plan to remove obstacles in the implementation of the project to solve flooding caused by tides in the Ho Chi Minh City area, taking into account climate change factors (phase 1).
In order to have enough basis to synthesize and report before October 5, following the direction of Prime Minister Pham Minh Chinh, the Government Office respectfully requests ministries and agencies to promptly provide specific written opinions on the content of the report, solutions and legal basis, authority to resolve the problems mentioned in the petition of Ho Chi Minh City.
At the end of September, the Chairman of the Ho Chi Minh City People's Committee submitted to the Prime Minister a plan to remove obstacles for the 10,000 billion VND flood prevention project.
Currently, there are three main difficulties that the project is facing: No capital to complete the project. The authority and implementation procedures for the project in the process of implementation have not been clearly defined. The changes lead to the project falling under the criteria of a national important project and finally, there is no basis for payment of the BT contract.
The reason is that the project is in a transitional case according to the provisions of the Law on Investment under the public-private partnership method; Resolution No. 98/2023 of the National Assembly and Decree No. 35/2021 of the Government.
HCMC has submitted to the Prime Minister these problems and proposed solutions. Accordingly, the City proposed to adjust the payment terms in the contract in parallel with the overall adjustment of the project.
Specifically, simultaneously carry out procedures to adjust the project implementation time, as a basis for signing the BT contract appendix to change the payment plan. After adjusting the BT contract appendix, the project basically overcomes the shortcomings of Resolution No. 40/2021 of the Government.
This is the basis for the City to start making payments using land funds, which are the land plots identified in the BT contract according to current regulations.
Only then can we solve the capital source for investors to complete the project, and reduce the cost of interest incurred while waiting for the completion of project adjustment procedures.
